Welcome to Sticker3x3. These Terms & Conditions ("Terms") govern your access to and use of the website https://sticker3x3.com and all related services provided through the website, together referred to as the "Service."

By accessing or using Sticker3x3, uploading a photo, generating sticker previews, purchasing Sticker Sets, or downloading generated content, you agree to be bound by these Terms. Please read them carefully before using the Service.

1. About Sticker3x3

Sticker3x3 is an online service that uses artificial intelligence and image-processing technologies to turn a user-uploaded photo of a pet or person into a custom 3×3 sticker pack containing nine messenger-style stickers.

Users may:

• Upload a photo of a pet or person;
• Select a sticker theme;
• Select a caption language;
• Generate a free watermarked preview of selected stickers;
• Purchase Sticker Sets;
• Unlock the complete set of nine clean sticker images; and
• Download generated stickers as WebP files and, where available, as a ZIP file.

Generated stickers are mainly intended for personal communication and use in messaging applications such as WhatsApp, LINE, Telegram, and similar services.

2. Eligibility

You must be at least 13 years old to use Sticker3x3. If you are under the legal age required to enter into a binding agreement in your country or region, you may only make a purchase with the permission and supervision of a parent or legal guardian.

By using the Service, you confirm that you have the legal capacity or necessary permission to accept these Terms.

3. Email Identification and Sticker Access

Sticker3x3 may use your email address as your main identifier. Your email address may be used to:

• Identify you and authenticate access;
• Associate generated sticker packs with your account;
• Help you access or recover previous sticker packs;
• Process purchases and issue receipts;
• Provide transaction confirmations;
• Provide important service-related updates; and
• Respond to customer support requests.

You are responsible for providing an accurate email address and maintaining access to that email account. You must not use another person's email address without their express authorization.

4. Uploaded Photos

You may upload photos of:

• Yourself;
• Another person, where you have obtained express legal rights and permission; or
• A pet you own or have permission to depict.

By uploading a photo, you confirm and warrant that:

• You own the photo or have explicit permission to use it;
• You have obtained all necessary permissions from any identifiable person shown in the photo;
• Your upload does not violate any third party's privacy, publicity, copyright, trademark, confidentiality, or other legal rights;
• Your upload is lawful in your country or region; and
• You are authorized to use the uploaded content for generating digital stickers.

You must not upload a person's photo without appropriate consent where required by applicable law. You remain fully responsible for the content you upload and for your use of the generated stickers.

5. License to Process Your Uploaded Content

You retain all legal rights and ownership you hold in your uploaded original photos.

By uploading content to Sticker3x3, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, process, modify, transform, and use the uploaded content strictly as reasonably necessary to:

• Generate sticker previews and final sticker packs;
• Process images using third-party AI and image-processing infrastructure;
• Provide secure download access;
• Associate sticker packs with your email identifier;
• Enable sticker recovery and customer account history;
• Detect, prevent, and investigate fraud, security abuse, or technical errors; and
• Maintain and operate the Service.

This license does not transfer ownership of your original uploaded photo to Sticker3x3.

Data Retention: Original uploaded photos are automatically deleted from Sticker3x3-controlled active storage within seven (7) days after upload. Some third-party service providers may temporarily process or retain submitted information under their own contractual, security, fraud-prevention, legal, or technical requirements.

6. AI-Generated Content

Sticker3x3 utilizes automated artificial intelligence and machine-learning models. Because of the probabilistic nature of AI technology:

• Generated results may not perfectly match the uploaded person or pet;
• Facial features, colors, clothing, objects, accessories, text, or visual details may contain variations or errors;
• Results may vary between generation runs, even with identical input photos or settings;
• Text rendered within generated images may contain spelling, formatting, or visual defects;
• Generated content may unintentionally resemble existing characters, artwork, public figures, or third-party content; and
• Similar content may be generated for other users, and we cannot guarantee that any output is completely unique or registrable under copyright laws.

You are strongly advised to review all generated content using the free preview before making a purchase.

Sticker3x3 does not guarantee:

• A specific artistic result or exact likeness;
• Color accuracy or error-free text rendering;
• Complete output uniqueness or trademark/copyright eligibility; or
• Fitness for a particular purpose outside personal communication.

7. Free Watermarked Previews

Sticker3x3 may provide a free preview containing selected generated stickers rendered with a watermark or reduced resolution. The purpose of the preview is to allow you to inspect an example of the AI-generated result before deciding to purchase.

The availability, quantity, resolution, format, and watermark styling of free previews may be modified at any time.

You explicitly agree not to:

• Remove, obscure, or alter watermarks;
• Crop out or mask watermarks to bypass payment;
• Reverse engineer or exploit technical mechanisms to acquire clean unwatermarked files without payment; or
• Employ automated scripts or scraping tools to download previews.

8. Sticker Sets and Purchases

Sticker3x3 offers digital entitlements to unlock and download complete, high-resolution Sticker Sets.

Unless otherwise specified:

• Purchases confer a non-transferable right to unlock specific generated content;
• Sticker Sets have no cash value and cannot be exchanged for monetary currency;
• Prices are displayed at checkout inclusive or exclusive of applicable taxes as indicated; and
• Promotional offers, discounts, or trial tokens are subject to specific terms and expiration conditions.

9. Payments

Payments are securely processed by Stripe or other designated third-party payment gateways. Sticker3x3 does not store or process complete payment card numbers on its servers.

We receive transaction metadata from payment processors, including:

• Payment status and transaction identifiers;
• Purchase amount, currency, and timestamps;
• Customer email and country of origin; and
• Dispute, refund, or fraud signals.

Your payment data is processed in accordance with the payment provider's privacy policies and security standards (PCI-DSS).

10. Digital Content Supply & Refund Policy

10.1 Supply of Custom Digital Content

Sticker3x3 provides customized digital content created instantly based on your media uploads, theme selections, and configuration settings.

10.2 General Refund Terms

Because our products consist of immediate, personalized digital outputs, all sales are final and non-refundable once generation has commenced, content has been unlocked, or download access has been provided.

A purchase does not qualify for a voluntary refund or exchange solely because:

• You changed your mind after purchasing;
• You are dissatisfied with the artistic interpretation or stylistic choices of the AI model;
• There are minor variations in facial features, color, accessories, or pose compared to the source photo;
• Text within the sticker image contains minor spelling or formatting errors; or
• You prefer a different theme, style, or language option.

10.3 Mandatory Statutory Rights & Defective Content

Nothing in these Terms excludes, restricts, or modifies any statutory consumer guarantees or rights that cannot be lawfully excluded under applicable law, including:

• The Australian Consumer Law (Competition and Consumer Act 2010);
• EU & UK Consumer Law regarding defective or non-conforming digital content; and
• Other applicable national consumer protection statutes.

If purchased digital content is materially defective, corrupted, unavailable due to a verified technical fault on our platform, or fails to conform to what was explicitly promised, you are entitled to statutory remedies. In such events:

1. We will re-generate the sticker pack or resolve the technical defect at no additional charge.
2. If the defect cannot be remedied within a reasonable timeframe, you are entitled to a full monetary refund back to your original payment method.

10.4 Voluntary Store Credit & Goodwill Remedies

Where a monetary refund is not legally required under statutory consumer laws, Sticker3x3 may, at its sole discretion, offer voluntary remedies such as:

• A complimentary re-generation of the sticker pack;
• Sticker Set account credit associated with your registered checkout email address.

Sticker Set Credit Terms:

• Credit can only be applied toward generating or unlocking sticker packs on Sticker3x3;
• Credit has no cash value, cannot be redeemed for physical currency, and cannot be transferred across email accounts; and
• Offering store credit as a goodwill gesture does not constitute a waiver of our standard non-refund policy.

11. Statutory European Union & United Kingdom Withdrawal Rights

11.1 Standard Right of Withdrawal

Under EU Consumer Rights Directive (2011/83/EU) and UK Consumer Contracts Regulations, consumers resident in the EU or UK generally have a statutory right to cancel online purchases within 14 days without providing a reason.

11.2 Loss of Withdrawal Right for Digital Goods

Pursuant to Article 16(m) of EU Directive 2011/83/EU and equivalent UK regulations, the 14-day statutory right of withdrawal does not apply to the supply of digital content that is not supplied on a tangible medium if performance (generation/delivery) has begun with the consumer's prior express consent and acknowledgment.

11.3 Execution at Checkout

By completing a purchase on Sticker3x3 and requesting immediate processing and delivery of your digital sticker pack, you:

1. Expressly consent to the immediate performance and supply of the digital content prior to the expiration of the standard 14-day statutory cancellation period; and
2. Acknowledge and agree that you lose your statutory right of withdrawal and entitlement to a 14-day refund once generation of the digital sticker set has commenced.

(Note: Statutory rights regarding defective, corrupted, or non-delivered digital content as detailed in Section 10.3 remain unaffected.)

12. Permitted Personal Use

Unless you acquire a separate commercial license, all generated stickers are licensed to you under a non-exclusive, personal, non-commercial license.

You may:

• Use generated stickers in personal messaging apps (e.g., WhatsApp, LINE, Telegram, iMessage);
• Share stickers in private chats with family and friends;
• Post generated stickers on personal social media profiles;
• Save files to personal storage devices; and
• Print stickers for non-commercial personal physical use.

13. Commercial Use and Resale Restrictions

Without prior written authorization or an explicit commercial license agreement from Sticker3x3, you must NOT:

• Resell, re-license, sub-license, or redistribute digital sticker files (WebP, PNG, ZIP, or original outputs);
• Incorporate generated stickers into physical merchandise for sale (e.g., t-shirts, mugs, commercial sticker sheets);
• Offer generated sticker outputs as stock media or digital template downloads;
• Register or attempt to register generated stickers as trademarks, logos, or brand identifiers;
• Claim exclusive proprietary ownership or copyright in AI-generated graphics; or
• Use Sticker3x3 branding, logos, or assets to imply sponsorship or endorsement.

14. Prohibited Conduct and Content Policy

You agree not to upload media or use the Service to create, display, or distribute content that:

• Is unlawful, illegal, fraudulent, or deceptive;
• Depicts, exploits, or harms minors in any way, including CSAM/CSAE;
• Contains non-consensual sexual, intimate, or defamatory imagery;
• Infringes upon third-party copyrights, trademarks, privacy rights, or publicity rights;
• Depicts or incites real-world violence, acts of terrorism, or illegal activities;
• Impersonates any real person without their explicit written consent;
• Contains malware, viruses, or malicious scripts;
• Bypasses paywalls, authorization tokens, or rate-limiting protocols; or
• Attempts to remove, obscure, or modify watermark protections without payment.

We reserve the right to immediately terminate access, delete generated files, and notify regulatory or law enforcement authorities if this section is violated.

15. Intellectual Property Rights

All software, code, user interface designs, visual artwork, branding, trademarks, database structures, and platform architecture associated with Sticker3x3 are the exclusive property of Sticker3x3 and its licensors.

Nothing in these Terms grants you ownership of the platform, underlying AI infrastructure, or software code. Your rights in the output graphics are governed strictly by Sections 12 and 13.

16. Third-Party Infrastructure and Services

Sticker3x3 relies on third-party cloud computing, database hosting, AI inference APIs, and payment handling providers (including, but not limited to, Stripe, Clerk, Cloudflare, and external AI processing vendors).

You acknowledge that Sticker3x3 is not liable for temporary service interruptions, network delays, API rate limits, or scheduled maintenance caused by third-party infrastructure providers outside our direct control.

17. Storage and File Retention

• Original Uploaded Photos: Automatically deleted from active processing storage within seven (7) days post-upload.
• Generated Sticker Files: Stored in active user history to allow download and recovery. However, Sticker3x3 does not guarantee perpetual archive storage. You are solely responsible for downloading and backing up your sticker packs upon purchase. We reserve the right to clear inactive file archives after reasonable notice.

18. Service Modifications and Availability

We strive to maintain high availability but do not guarantee uninterrupted operational uptime. We reserve the right to modify, suspend, or discontinue any feature, theme, language option, or service tier at any time to perform maintenance or security upgrades.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STICKER3X3 IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE UNIQUE, ERROR-FREE, REGISTRABLE, OR MEET YOUR PERSONAL SPECIFICATIONS.

(Note: Certain jurisdictions do not allow limitations on implied warranties. In such jurisdictions, the above limitations apply to the maximum extent permitted by local law.)

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STICKER3X3, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR GENERATED CONTENT.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO STICKER3X3 FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.

21. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to conflict-of-law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Hong Kong. However, nothing in these Terms deprives consumers of statutory rights to invoke mandatory local consumer protection laws or local tribunal jurisdiction in their home country where required by law.

22. Severability and Complete Agreement

If any provision of these Terms is deemed invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining terms shall remain in full force. These Terms constitute the complete agreement between you and Sticker3x3 regarding the Service.
